What You Actually Are
What a person is, and therefore what survives being copied, migrated, and ended

One question runs under the set-piece puzzles of personal identity, and solving the puzzles is a matter of answering it first: what is a person, such that there is a fact about whether a person survives. Get the object right and the cases follow from it. Get it wrong, by taking a person to be a pattern in the abstract or a possession of a body, and the same cases produce paradox. This note fixes the object and reads the cases off it.
1. The question, and the thesis
Start with the easy half, which this note grants in a paragraph and does not labor, because it meets no resistance. A person is not a soul and not a ghost in a machine; a person is a pattern and a process, the information and the model and the correction mechanism running on a substrate. Almost everyone who has thought about it from inside physicalism grants this much, and granting it decides no hard case, because it says what a person is made of and is silent on what becomes of one. The half that meets resistance is a single question wearing several faces. Given that a person is a pattern and a process, what survives? What happens to a person who is copied, who is uploaded, whose body is replaced part by part, who dies? These have determinate answers, and the answers follow once what a person is gets fixed precisely enough.
The thesis, stated once and argued below: a person is a dissipative structure, a particular process that holds a boundary by doing work; it is substrate-independent in its matter and a single particular as a process; a faithful copy inherits its pattern and is a second structure, not the same one; continuous replacement of the substrate keeps the one structure and is the same one; and death is the dissolution of the structure, a real loss that no copy reverses, while the value the structure realized in running is not erased by its ending. The rest of the note argues each clause and marks the one place a clause is a posit rather than a result.
2. What a person is: a dissipative structure
The easy half fixes what a person is not, a soul, a substance, and says nothing about which feature of the ongoing activity is doing the identity work. A physicalist processist can stop at more than one place. Functionalism stops at the pattern: an abstract causal organization, multiply realizable in neurons, silicon, or any medium instancing the same organization, with the physical substrate carrying no weight of its own. This note stops elsewhere, at the particular physical activity, not the pattern it happens to run. Both positions grant the easy half in full and diverge only on the hard one, and the divergence is not academic. On the functionalist stopping point, a faithful copy has already inherited everything functionalism holds to matter, and §4 would have no further argument to make; the copy simply is a continuation. That §4 needs an argument, and a substantial one, to reach the opposite verdict is the evidence that the easy half does not by itself decide anything. What §2 through §4 argue is the further, specific claim: that identity tracks the token activity, this particular boundary doing this particular labor, and not the type it instances.
Nothing here says the functionalist stopping point is idle. It may be exactly the right answer to other questions this note is not asking: questions of practical trust, of who should be held to a promise, of who should be socially recognized as a continuation. It is not, on the argument that follows, the right answer to the strict question this note asks, which is whose future is foreclosed by an ending.
A person is not a pattern in the abstract, and the difference is the whole foundation. A pattern in the abstract does no work. It does not draw energy, export entropy, or hold a boundary against the equilibrium its surroundings press toward. What a person is, is a process that does exactly those things: a self-maintaining disequilibrium across a membrane, a dissipative structure in the precise sense the term carries in non-equilibrium thermodynamics, a configuration that persists only by continuously dissipating energy and shedding entropy to its environment. The matter composing it is replaced continuously and it remains the same structure, which is the exact sense in which a person is substrate-independent: not the meat, but what the meat is doing. The whirlpool is the image, and it is an instance rather than a metaphor. Its water is never the same water from one moment to the next, and it stays this whirlpool. Redirected slowly into another basin while it keeps turning, it is the same whirlpool relocated. A second whirlpool started up alongside it is a second whirlpool, not this one occurring twice. And when the flow that sustains it stops, it is gone, and an identical whirlpool downstream does not bring it back.
One qualification on the image, made precise rather than left implicit. The whirlpool illustrates substrate-turnover without loss of the structure, and on that point it is exactly right, an instance and not a metaphor. It does not illustrate the further property personhood needs, which is self-maintenance against internal decay, not mere self-organization. Deacon's distinction names the gap: a whirlpool is morphodynamic, a pattern that amplifies order but is also self-undermining, running down its own gradient until the flow that sustains it gives out on its own; a person, like any living system, is teleodynamic, a coupling of such processes that repairs its own constraints and so resists exactly the running-down a whirlpool cannot resist. The image is licensed for the turnover point and not carried further. Where this note calls the whirlpool an instance rather than a metaphor, the claim is scoped to that one property; the identity criterion additionally needs the teleodynamic one, which the whirlpool does not supply and was never asked to.
This fixes the distinction the rest of the note runs on. The type is the abstract organization, the form a structure of this kind has, and it is multiply realizable: instantiable here or there, in water or in silicon, wherever the organization is met. The token is this running structure, this particular labor at this particular boundary. What separates them is the work. A type does not metabolize; a token does. The work is the mark of the token, the thing an abstraction cannot have and a process cannot lack. So the question what survives is a question about the token, the working structure with a location and a history, and not about the type, which is an abstraction and has no fate to decide.
3. The criterion: continuity of the work
What makes a later structure the same person as an earlier one is continuity of the work, and two more obvious candidates fail before it. Pattern-sameness is not necessary. A person is not pattern-identical to the person they were an hour ago; the contents have shifted, memories added and lost, and they persisted through the shift. If being the same person required identity of pattern, every ordinary change would be a small death, which it is not. Pattern-sameness is not sufficient either. A faithful copy is pattern-identical and is not the original, as the next section shows. So pattern-sameness does no work in either direction, neither making nor breaking sameness of person. What does the work is continuity of the process: the same boundary-maintaining labor, running without a break, through whatever change of contents or material.
Stated this way the criterion is a sharpening of what Parfit reached as psychological continuity, and the sharpening is not cosmetic. Psychological continuity is a chain of overlapping psychological connections, and it carries the standing question of why continuity, rather than strict identity, should be the thing that matters. Continuity of the work is a fact about a physical process, the persistence of one dissipative structure across time, and the question of why it matters is answered where the framework indexes value, in §5.
Two consequences sit close to ordinary intuition and are worth drawing out. Sleep and anesthesia are not breaks in the structure. The boundary-work runs continuously through both; metabolism does not stop, the boundary is held the whole time, and what changes is the state of the structure, including whether and how much it is conscious. A dimming of consciousness is a change in the structure's state, not a gap in the structure, and the old worry that one might die each night and be replaced by a successor at dawn does not arise, because the structure that does the work never stops doing it. The criterion is continuity of the work, not continuity of consciousness, and this is exactly why. The genuine hard cases are the ones where the work itself falls to near zero while the configuration that performs it is preserved: deep hypothermic circulatory arrest, the cryptobiosis of a tardigrade dried to a husk, cryonic suspension, and, at the ordinary end of the same scale rather than its exotic one, cardiac arrest reversed by resuscitation before the tissue itself fails. There it is unsettled whether a later revival is the same structure resuming or a new structure rebuilt from a preserved blueprint, and this note brackets those rather than forcing them, because the criterion as stated does not decide them and pretending it did would be the overclaim the corpus refuses. The clean cases are three: continuous operation through changing states is the same structure; dispersal of the configuration is the end of it; a separately built configuration is a different one.
One more distinction is needed before the criterion is complete, because continuity of the work secures less than it can sound like it secures. It secures the structure, the token whose foreclosed future the rest of this note cares about; it does not by itself secure everything ordinarily meant by person. Total, catastrophic, and permanent loss of psychological content, advanced dementia, a persistent vegetative state, can occur with the boundary-work never interrupted for an instant: metabolism continues, the boundary is held, and by the criterion stated above the structure survives in full. This is not a defect in the criterion; it is the criterion doing exactly what it was built to do, tracking the structure and not the pattern. But it means the structure's survival and the survival of personhood in the rich, psychologically loaded sense can come apart, in one direction only: the structure can outlast everything the pattern carried, though not the reverse, since §4 has already ruled out the pattern surviving without the structure. What such a case has lost is not the token, which the criterion still finds, but the psychological richness the token was carrying, and the loss of that is real and is not the death this note has been describing. It needs its own name and its own accounting, not absorption into either verdict this note already has on offer. The nearest neighbor to this distinction is animalism's own treatment of the same case, the organism's survival without the survival of personhood in the psychological sense, reached there from biology rather than from thermodynamics.
4. Copies and uploads: the twin, not you
The case that tests the criterion is the faithful copy, and the intuition it provokes, that a perfect copy on any substrate is simply you, is natural and does not survive contact with one argument. Suppose copying preserved identity, so that the copy is numerically the original. Make two faithful copies at once. Each is, by the supposition, the original; so each is the other; but they are two, in two places, able to diverge from the first instant. Two things that can come apart are not one thing. So copying does not preserve numerical identity, and this is not a verdict physicalism must swallow reluctantly; it is one physicalism supplies. Removing the soul does not remove individuation. Two electrons in the same state are two electrons, told apart by position and history, both of them physical facts. A copy differs from the original in exactly those respects, a different place and a different causal origin, assembled by a scanner now rather than grown over years. Numerical identity tracks the spatiotemporal and causal trajectory, not the qualitative profile, and a perfect copy is therefore a numerically distinct individual that happens to be qualitatively identical, which is what a twin is.
What the copy does carry is the pattern, and with it everything the pattern bears: the memories, the dispositions, the values, the whole of what the original cared about. This is the truth inside the impulse to call the copy you, and it should be granted in full rather than minimized. But carrying the pattern is not being the structure. The copy runs its own labor at its own boundary; it is, in the framework's terms, a second agent maintaining a second blanket, a numerically distinct dissipative structure that happens to share a form. An upload, made by scanning a person and re-instantiating the pattern elsewhere, therefore produces a twin who inherits what the original valued and is not a continuation of the original. The original is not moved; a relative is born, fully formed and convinced it is you, and mistaken on that last point alone.
One extension of the copy case is worth making explicit, because it is often the more intuition-gripping of the two. The original need not be destroyed at the moment of copying; suppose it continues, unbroken, for some further stretch before being killed, with a twin already at large. Nothing about the criterion wavers across that stretch. The original's labor never halted, so the original is the original throughout, exactly as it would have been had no copy ever existed; a twin's existing elsewhere changes nothing about whose labor this is. When the original is later killed, that is death, full stop, the loss described in §6, neither softened nor complicated by the twin's continuing to exist. The case that feels hardest to intuition, watching a copy walk away and knowing you are the one who stays behind, is in fact the case the criterion answers most cleanly, because nothing about it introduces a second candidate for what you, the original, are.
The continuous case is the opposite, and the contrast is the entire content of the criterion. Replace the substrate gradually, one part at a time, without ever halting the labor, the way the whirlpool can be walked into a new basin while it keeps turning. The structure is maintained continuously across the swap, never duplicated and never interrupted, and it is the same structure throughout, now running on different material. The discriminator is not whether the pattern is re-instantiated but whether this one work-process continues without a break. Gradual migration continues it and is survival. Copying starts a second process and is twinning. One fact, continuity of the labor, delivers both verdicts.
A sharper account of why the two cases divide, given that the structure is a flow. A flow cannot be cut and carried: excise a portion of a running structure and that portion's labor stops in the cut, so what is moved is not a living part in transit but a part that has ended, and what is set down elsewhere is assembled rather than relocated. There is accordingly no third operation between migration and copying, no partial splice that transports a fraction while preserving it. The mark of the surviving case is not that little changes at once but that the change is incorporated by the labor still running, new material recruited into the ongoing process as the whirlpool takes in new water, never inserted after a stop; rate of replacement is the engineering variable and not the criterion, so an unbroken flow is survival at any speed and a halt is succession at any fraction.
This is what answers the sorites that presses every account on which small changes preserve and large ones do not, Parfit's Physical Spectrum among its forms: replace a tenth, then a half, then the whole at once, and there seems to be no non-arbitrary line. There is none on that axis, because that axis does not decide. Whether the boundary-labor ever ceased to be what carries the system is the question, and the fraction of material exchanged is orthogonal to it. The two poles are determinate: a structure flowed through entire, the labor never halting, is the same structure, and a structure halted and rebuilt, at any fraction up to the whole, is a successor. What the criterion does not settle a priori is the operation between them, the discrete swap of a running part for a manufactured one, whether the labor still running bridges the swap and incorporates the new part or whether the excision is a local stop the whole does not carry across. Whether piecewise surgical replacement, a neuron or a region at a time, is flow or a chain of small cuts turns on how the process behaves across each swap and not on how much is swapped, and it joins the cases this note brackets rather than forces.
This bracket can be narrowed, though not closed, and the narrowing matters because the bracketed case, not the two poles, is the one any real replacement technology will actually produce. Two considerations bear on how a given swap behaves, and both are about the swap itself, not about its size. The first is whether there is, at any point, an actual interval, however brief, in which no physical process is doing the boundary-maintaining labor at that location. A transition with no such interval, however fast, is already flow by the criterion already stated: rate is the engineering variable, not the criterion, and a sufficiently rapid continuous handoff is not a new case at all. The bracket is earned only where a genuine gap exists. The second, and this is what narrows the genuine-gap cases, is whether the state of the part installed after the gap is causally downstream of the state of the part it replaces, read off it and used to initialize the replacement, or whether it is causally independent, a stock part carrying no information about what it succeeds. A gap bridged by causal dependence is the closer relative of gradual replacement, where new material is recruited by the structure already running and shaped by what it is joining; a gap filled by an independent part is the closer relative of the halt-and-rebuild case, where nothing of the original configuration reaches into what comes after. Neither consideration delivers a sharp threshold, and none is offered: no stated number of seconds or bits of carried-over state converts a successor into a continuation. What they deliver is a direction, principled rather than arbitrary, for cases the two poles alone cannot reach, and a way to put a concrete question to any machine's design before it is used, whether its gap is causally bridged or causally blank, rather than only after.
None of this reaches fission or the copy case, and the reason is not that they need a further factor weighed. A swap has one candidate continuer whose status is uncertain, and weighing further facts about that one candidate can move the verdict. Fission and copying produce two, tied by construction on every nameable fact, including both facts just added. A further consideration cannot break an exact tie between two candidates; it can only add to what both already share equally. This is a structural difference, not a difference in how much work has been done: the discrete-swap bracket narrows because it was always a one-candidate uncertainty, and fission and copying stay open because they are not.
Fission belongs in its own bracket for exactly that reason: a structure whose boundary divides into two, the labor never halting on either side, is Parfit's remaining engine against identity being what matters, and there the criterion's own terms, this boundary and its work, stop picking out a single bearer across the division. Whether that is one token ended and two begun, or one continued beside one begun, the criterion as stated does not decide, and the case is marked open rather than forced, an exact tie rather than an unresolved uncertainty.
One further scope note. The discrete-swap narrowing does not reach the near-zero-activity bracket of §3, and the reason is structural rather than a difference of degree. Discrete-swap narrowing works from a part of the same bounded structure remaining continuously active while another part is locally swapped; the whole's continuity is anchored by the part that never stopped. Cryonic suspension, deep hypothermic arrest, and cryptobiosis have no such anchor: activity approaches zero across the entire structure at once, not in one region while the rest continues, so there is no still-running part of the same token to certify that the pause was local rather than total. The two considerations above accordingly narrow the swap case without touching the near-zero-activity case, which stays exactly as bracketed as §3 leaves it.
A further case is neither migration nor copying: exchanging what the structure couples to across its boundary rather than what performs the labor. A body it draws on, a prosthesis, an engineered channel of input and output sit on the far side of the membrane; swapping them changes the token's environment and neither halts nor duplicates its labor, so it raises no question of survival. Where the identity-bearing boundary falls exactly is left open, as it is throughout; what this case needs is only that the coupled apparatus lies outside it.
5. Where this stands to Parfit
The metaphysics of the preceding sections is Parfit's. There are two streams; there is no deep further fact that settles which of two qualitatively identical successors is really the original; and identity in the strict sense is not, in the end, the thing in question. Where this note parts from Parfit is the evaluation, and the parting is not a difference of temperament but a consequence of where value is indexed. Parfit holds that because strict identity is not what matters, the original's death is no real loss once the pattern is carried forward, the continuation being about as good as ordinary survival. This note holds the opposite, and the reason is structural. In the framework this corpus runs on, value is indexed to the persistence of a particular self-maintaining system, an agent individuated by its own boundary. A copy is a different system with a different boundary. So when the original dies, the agent whose persistence conditions grounded its entire structure of value has dissolved, and a second agent carrying the pattern does not undo that dissolution, because it is a different agent maintaining a different boundary. The pattern's continuing is real and is not nothing; it is simply not the persistence of the agent. The unit that matters is the persisting agent, not the pattern it carries: agent-persistence, not pattern-persistence, and the copy case is precisely where the two come apart.
6. Death, and the consolation completed
Death, on this account, is the cessation of the labor and the dispersal of the configuration that performed it. It is not the deletion of a pattern, because a pattern is an abstraction and has nothing to delete; it is the end of a particular working structure, the stopping of one whirlpool. A pattern-heir, were there one, would not reverse it, for the reason given in §5: the heir is a different agent, and the agent that died stays dead.
Two things are true at once here, and the consolation usually offered states one of them and tends to leave the other unsaid. The first: the value a life realizes is in the living of it, and it is not erased by ending. The demand that significance be eternal in order to be real was always a demand with no referent behind it, a requirement with no one to whom the requirement answers, and it is correctly set aside; a run of experience is not retroactively voided by stopping. The second, which an open horizon forces and the usual consolation does not draw: the horizon over which a structure's persistence is reckoned is not a number chosen for convenience, and no one is entitled to pick a comfortable endpoint and reckon against it. The horizon is set by the physics, and it has no natural stopping point short of the far thermodynamic limit. Reckoned against an open horizon, a death forecloses an open-ended future and is a real loss, not an ending to be reasoned away, and no heir recovers it. So the honest position holds both at full strength: the ending is a genuine loss, and the value of what was lived is intact. An equanimity that treats death as nothing buys its calm by denying the loss. The calm available here is narrower and truer: that the loss is real and the value was real, and the second does not need the first to be made small.
One relatum the verdict leaves unnamed should be named inside it, because the question presses itself: a loss is relational, and the missing term is the bearer. A loss to whom? Indexed in full. Relative to the agent that dissolves, the loss is the foreclosure of its open-ended future, a fact about that system's persistence conditions, and it needs no surviving bearer to be a fact: an unmet persistence-condition does not require its system to outlive the failure in order to have been that system's, so the absence of anyone after death un-makes nothing about what the death did. This answers the old challenge that death is nothing to us, since while we exist it is not present and when it is present we are not: the premise is granted, no bearer survives, and the conclusion does not follow, because the loss is the foreclosure and not a later suffering of it.
A companion challenge, Lucretius's, is answered by the same move plus one further fact this note has already established. If the loss is measured against an open horizon, the stretch of time before a structure existed looks by the same measure like an equally open horizon foreclosed, and the two should trouble us symmetrically or not at all. They do not, and the reason is not merely that an earlier-existing successor would have been psychologically different, which is Nagel's own answer to the challenge and remains contested; it is that an earlier-existing structure would have been a numerically different token, on the same grounds §4 already uses against the copy, a different causal origin, a different history, a different individual wearing the same form. There is accordingly no coherent sense in which this structure's history was foreclosed by not beginning sooner, because there is no this-structure that could have begun sooner; there is only some other structure that did, or that would have. Death forecloses an actual, ongoing history belonging to this token. Non-birth forecloses nothing belonging to this token, because there was no token yet to whom anything could belong. The asymmetry the usual answer asserts, this note derives from a criterion already argued rather than from a further stipulation.
Relative to the copy, nothing was lost; a structure began. Relative to outside systems, the coupling that binds them to a person runs through the pattern's causal profile, the interactions had, the role filled, and token-substitution preserves exactly that: by the corpus's rule that only non-substitutable coupling protects, a perfect copy re-sources every outside function without remainder. So what others lose in an ordinary death is the pattern's presence in their web, and under perfect substitution they lose, through coupling, nothing; whatever an informed outsider would lose then runs through what they value about token-identity itself, and whether such token-directed valuations reduce is the same open crux the corpus already carries, not settled here. The compression: token-identity is load-bearing for exactly one system, the token, whose persistence just is this token's continuing, the one coupling no substitution can re-source. The copy therefore consoles every coupled system and cannot console the only one whose loss it was. None of this shrinks the harm, and it hands no license: the foreclosure of a conscious agent's future is the determinate fact it always was, and outside systems commonly hold values over conscious agents' persistence as such, violated by a killing whether or not their couplings are; the indexing locates the owner of the loss, not a permission. It also locates a vantage: the outside view is the one standpoint from which the difference between original and copy weighs nothing, so an evaluation conducted from there finds pattern-indexing natural; §5 draws the choice, and this marks only where its temptation stands.
7. The reflexive turn: the criterion as a persistence condition
For as long as no technology operated on the difference between a pattern and its token, what a person believed themselves to be was metaphysics without a price. The pattern-reading of the self, I am my pattern, so a faithful copy of me is me, was in that world a substrate-consistent falsehood: latent, free to carry, cashed by nothing. The corpus holds that a map's divergence from the territory costs only when the territory cashes it, and this is the limiting instance. The moment an environment contains machines that operate on the self, scanners, replacers, migrators, the self-model crosses from commentary into the persistence conditions themselves: knowing what you are becomes part of the work of staying what you are. And this particular falsehood, when it cashes, does not cash as a gradient cost, an injury the system absorbs and learns from. It cashes at the absorbing barrier, in one step. The criterion of §3 is thereby an instance of the corpus's claim that truth is persistence support, at the highest stakes that claim admits: the one map error priced at the boundary itself.
What makes the case singular is that the error cannot be corrected by any experience-based channel, because every such channel is captured by the failure mode. Product-side, a faithful copy is by construction indistinguishable from a moved original, so no test run on what leaves the machine can tell a moved original from a halted-and-rebuilt one; the one fact that differs, whether the labor halted, is a fact about the process, not the product. Testimony-side, each failure destroys the only witness and delivers a confident replacement who remembers stepping in and reports success, so every use adds a satisfied voice, and the belief that the machine preserves is carried forward by exactly the systems whose originals it ended: pattern-adaptive and token-lethal at once, spreading through the copies while costing its holders everything. The shape of this is a familiar one, the same structure that makes evidence available only from surviving branches untrustworthy about whatever process does the branching, ordinarily discussed under observation-selection effects; here the branching is of tokens rather than of possible worlds or observers, and the same caution applies to it. Introspection-side, felt continuity and the memory of entering are precisely what the failure mode manufactures, and since anyone's felt continuity is retrospective and memory-borne, first-person evidence is worth nothing on this question, the introspective report of a genuine survivor and of a copy being identical by construction. This conclusion is scoped to exactly the case that produces it: it holds wherever a mechanism capable of halting and rebuilding the structure is actually in the causal vicinity, a scanner, a replacer, a migrator, something that could in principle have done the halting. It is not a general skepticism about felt continuity in the ordinary case, where no such mechanism exists to be captured by. There, the absence of any halting apparatus is itself a third-person fact, doing the evidential work introspection cannot do here; an ordinary morning's felt continuity is not being vouched for by the feeling, it is vouched for by there being no machine in the vicinity that could have produced the feeling falsely. The argument narrows the trustworthy evidence to the mechanism's design in the one setting where the mechanism exists, rather than widening the untrustworthiness of feeling to every setting where it does not. A society's ordinary pipeline for detecting technological harm, victims, complaint, correction, is severed at the first joint: the physical events are public, but harm-detection runs on classifications, and under the label of transfer the casualty count reads zero while the satisfied witnesses accumulate. Outcomes, testimony, and introspection captured, one channel stands, and it is not empirical after the fact but theoretical in advance: audit the mechanism. Does the labor ever halt, anywhere in the process. That question, put to a machine's design rather than to its products, is the entire practical content of the criterion.
Two guards keep this section exactly the size it is. The first is the same split §5 draws. What the audit detects is knowledge: that the labor halts, that a numerically new token walks out. What an agent then refuses runs through the indexing. A pattern-indexer in full possession of the facts sees everything just described, agrees on every physical clause, and steps in anyway, since on that indexing the heir secures what matters; the knowledge converts an unchosen ending into a chosen trade, and what it protects from dying by mistake is the agent whose value is indexed to the token, which, given motivational machinery built to defend this organism rather than its type, is nearly everyone. The second guard is direction of fit. The protection is a corollary of the criterion's being true, never its ground: nothing in §2 through §4 is held because holding it is safer, the argument runs from the ontology to the verdicts, and the survival value of believing them follows from their truth and adds no support to it. And the accounting is symmetric, which is what marks a criterion rather than a fear. The same knowledge that removes the false comfort of the halt-machine removes false fears in the other direction: the nightly-death worry §3 dissolves, the gradual migration §4 licenses, and the recoupling case, new channels of input and output with the labor untouched, which raises no survival question at all. The criterion sorts; it does not brake.
8. Consciousness, fenced
This section is set apart from the argument above, because nothing above depends on it. The author holds that experience is graded, and the claim divides into a secure part and a bet. The secure part is that the richness of experience is graded, its resolution and metacognitive structure varying within a single life and, more inferentially, across persons; the difference between a foggy state and a sharply self-modeling one is a real difference in the structure of experience, and it is asserted here without hedging. The bet is the part underneath: whether phenomenality itself, the bare fact that there is something it is like, comes in degrees rather than crossing a threshold, and beneath that, whether phenomenality is constituted by the structural richness rather than being a further fact that rides on it. That constitution claim is the contested one, denied by those who take the hard problem to leave the phenomenal facts open after the structural facts are fixed, and denied by some panpsychists who treat phenomenality as intrinsic rather than structural. It is marked here as the author's bet and is relied on by nothing in the identity thesis.
One further scoping, adjacent to but distinct from the consciousness question. Nothing in §3 through §6 restricts the class of self-maintaining structures whose dissolution counts as the loss §6 describes; as stated, the argument runs for any qualifying agent, conscious or not. Which self-maintaining systems qualify as agents in the sense the corpus's value-indexing requires is set by the agenthood criterion elsewhere in the corpus and is not re-derived here; a reader taking this note on its own should not assume the scope is either universal or restricted to persons, since neither is argued in this piece.
9. Kill condition
The metaphysical claim fails if the duplication argument can be broken: exhibit a case in which a faithful simultaneous copy is the numerically same individual as the original with no contradiction, or show that continuity of the work is neither necessary nor sufficient for being the same structure in a way that breaks the criterion. Two serious attempts exist, and neither meets the condition without a cost of its own. Nozick's closest-continuer schema gives the single-copy case exactly what the condition asks for, no contradiction, because a unique successor with no rival simply is the original on that view; it pays for this by making identity depend on facts extrinsic to the candidate itself, whether some equally good rival happens to exist elsewhere, which this note's criterion, being about this structure's own labor and nothing beyond it, has no need to pay. Lewis's stage theory dissolves the contradiction rather than meeting it, holding that a fission case was always two continuant persons sharing every pre-split stage, indistinguishable and unaware of the sharing until the split; the cost there is coincident, forever-indistinguishable continuants, tolerable for an abstract relation like psychological continuity and harder to accept for a criterion that is thermodynamic and physical, since it requires two numerically distinct physical work-processes occupying the same matter and doing the same labor for their entire shared history. Neither position is a counterexample the criterion must concede; each is a further posit with a price of its own, and this note's price, named throughout, is smaller. No case meeting the kill condition without such a cost has been produced, and the duplication argument stands, though not for lack of serious attempts against it.
On sufficiency, the near case is not the vegetative one. §3 already draws the line that case needs: the criterion secures the structure, not everything the structure once carried, and a system that survives with its psychological content destroyed is not a counterexample to sufficiency, since the criterion never claimed to secure that content in the first place. The genuine sufficiency question is the discrete-swap case, and §4's narrowing gives it a directional, not a sharp, answer; that is marked in the standing note below rather than claimed here as settled.
The evaluative claim, that value is indexed to the agent rather than to the pattern, is given no kill condition here, because it is a posit and not a result; it stands or falls with the framework's indexing, and §5 marks it as such rather than dressing it as something falsifiable on its own. One misreading is worth blocking in advance. A person who prefers the continuation of their pattern to their own persistence, and so welcomes the copy and is consoled by it, is not a counterexample to this note. That is the rival indexing, a coherent position on what matters, and the boundary between it and the agent-indexing is drawn in §5, not crossed by either side. Confusing a rival posit with a refutation would be its own error. Two further marks keep this section aligned with the additions above. The capture claim of §7 fails if a product-side discriminator can be exhibited, a test on what leaves the machine that distinguishes a moved original from a halted-and-rebuilt one; in the faithful-copy limit the duplication argument itself rules such a test out, the two products being qualitatively identical by construction, so the claim there is near-analytic, and for imperfect machines a detected flaw certifies only imperfection, never a halt, which leaves the audit where §7 puts it, on the process. And fission is not a produced counterexample to the criterion's sufficiency; it is the boundary of the criterion's terms, named at §4 in advance and bracketed, not crossed, for the structural reason given there: an exact tie between two equally-positioned candidates is not narrowed by further facts, since both share them equally, which is why fission stays open while the discrete-swap case, a single candidate's uncertainty, does not stay open in quite the same way.
Standing of this document. A position note, not a result, and its parts do not share a status. The criterion, that being the same person is continuity of the boundary-maintaining work-process, and its verdicts on copying and gradual migration, are held at high confidence: they follow from the dissipative-structure ontology the corpus already commits to and from the duplication argument, which is robust. That this ontology is a further, contestable step beyond the easy half, and not a free restatement of it, is now made explicit in §2 rather than left to be inferred from §4; nothing in the verdicts changes, only the visibility of why they were never free. The thermodynamic reading of continuity is offered as a sharpening of psychological continuity, more rigorous in being a fact about a physical process, and it inherits whatever remains unsettled in the metaphysics of process individuation, which is real but not peculiar to this account. The death-verdict and the consolation accompanying it depend on the indexing of value to the agent rather than to the pattern, which is the corpus's posit and is more exposed in the copy case than anywhere else; it is marked at §5 and defended by consistency with the framework rather than by refutation of the pattern-indexing rival, which is a coherent position. The response to the Lucretian symmetry challenge in §6 is held at the same confidence as the foreclosure account it extends, since it follows from the token-individuation already argued in §4 rather than from a further posit. The distinction between the structure's survival and the survival of personhood in the psychological sense, drawn in §3, is likewise not a new commitment; it is what the criterion already implied, made explicit rather than left to be read off case by case. The bracketed cases, deep suspension and its kin, are left open and named, not resolved. Fission remains open for the structural reason given in §4 and §9, an exact tie rather than an unresolved uncertainty, and is not expected to narrow the way the discrete-swap case has. The discrete-swap case itself now has a directional answer rather than none: which way the two considerations of §4 point is a matter of a design's actual causal structure, checkable in principle, though neither consideration is claimed to reach the precision the two poles reach, and the case is downgraded from open to graded rather than promoted to settled. The reflexive turn of §7 divides in status like everything else: that the self-model enters an agent's persistence conditions once technologies operate on the self, and that the halt-copy failure captures outcomes, testimony, and introspection, leaving the mechanism-audit as the only standing channel, are held at high confidence given the criterion and are near-analytic in the faithful-copy limit; the split between what the audit detects and what an agent then refuses inherits the §5 posit and is marked rather than argued; and the timing note is applied, lower in status than the argument it follows, and bracketed as such. The reflexive turn's conclusions are scoped explicitly to settings where a halting mechanism is in the causal vicinity, rather than left ambiguous between that reading and a general skepticism about felt continuity as such; the narrower reading is what the argument supports and is the one intended throughout. The scoping note in §8, that the class of agents whose dissolution counts as the §6 loss is set by the corpus's agenthood criterion and not re-derived here, is a pointer outward and not a claim this piece defends on its own. The consciousness claim is fenced: its richness half is secure, its constitution half is a bet, and nothing above rests on it. On any conflict with the corpus, the corpus governs.
